These Terms of Use (“Terms”) govern access to and use of https://www.towwind.com/ and its content. The Site is operated by Shenzhen Towwind Technology Co., Ltd. (“Towwind”, “we”, “us”, or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1 Scope of the Site

The Site provides general information about Towwind, industrial blowers, applications, technical topics, and ways to contact us. Site content is provided for general business information and preliminary product evaluation. It is not engineering advice for a particular installation and does not replace review of actual operating conditions, specifications, safety requirements, manuals, quotations, or contracts.

2 No Online Sale or Automatic Acceptance

A product description, selection guide, calculator result, technical article, inquiry response, or request for quotation on the Site is not a binding offer, order acceptance, performance guarantee, or warranty. Any sale or supply of products or services is governed by the applicable quotation, order confirmation, specification, and separately agreed sales terms. If those documents conflict with these Terms regarding a sale, the separately agreed documents control.

3 Permitted Use

You may access and use the Site for lawful personal or internal business purposes, including evaluating Towwind products and contacting us. You may link to publicly available pages in a fair and non-misleading manner that does not imply sponsorship, endorsement, or affiliation.

4 Prohibited Conduct

You must not:

Use the Site in violation of applicable law or another person’s rights.
Attempt to bypass security, gain unauthorized access, introduce malware, disrupt operation, or test vulnerabilities without written authorization.
Use automated means to extract substantial Site content or burden the Site, except as permitted by law or a written agreement.
Misrepresent identity, affiliation, authority, or the source of a communication.
Frame the Site, create a misleading link, remove notices, or use Towwind names or marks in a way likely to cause confusion.
Submit unlawful, infringing, deceptive, harmful, or malicious material.

5 Intellectual Property

The Site and its text, graphics, photographs, videos, logos, product presentations, layout, software, and other content are owned by or licensed to Towwind and are protected by applicable intellectual-property laws. Towwind and related names and logos are trademarks or identifiers of Towwind. No ownership right or license is granted except the limited right to use the Site under these Terms.

You may download or print a reasonable amount of publicly available content for internal evaluation, provided that it is not modified, commercialized, republished as your own, or stripped of notices. Any other reproduction, distribution, adaptation, public display, or commercial use requires prior written permission unless permitted by law.

6 Inquiries, Files, and Other Submissions

You retain ownership of pre-existing information and intellectual property submitted through an inquiry form or other communication. You grant Towwind a limited, non-exclusive right to use, copy, translate, and share the submitted material only as reasonably necessary to evaluate and respond to the request, prepare a quotation, provide requested products or support, protect legal rights, and comply with law.

We do not acquire ownership of your pre-existing intellectual property merely because it is submitted to us. You should submit only information you are authorized to disclose and that is reasonably necessary for the request. Do not send passwords, payment-card data, government identifiers, unlawful material, export-controlled information without prior authorization, or highly sensitive personal information.

Unless Towwind has entered into a separate written confidentiality agreement, a submission does not by itself create a fiduciary relationship or obligations beyond these Terms, our Privacy Policy, applicable law, and any confidentiality commitment expressly made in writing. We will not intentionally publish customer-specific technical files or identify a customer in marketing without appropriate authorization.

7 Accuracy and Product Information

We seek to keep Site content useful and current, but specifications, dimensions, performance information, availability, images, and descriptions may change and may contain errors. Illustrations may be representative. Product suitability depends on actual conditions, including airflow, pressure, temperature, altitude, medium, duty cycle, electrical supply, installation, control requirements, and applicable standards. Confirm all material requirements in a written quotation or specification before relying on them.

8 Calculators and Technical Content

Any calculator, selection result, chart, blog article, checklist, or other technical resource on the Site provides an initial reference only. Results depend on the accuracy and completeness of inputs and assumptions. A qualified person should verify final selection, installation, electrical work, controls, safety measures, and compliance with applicable codes and standards.

9 Third-Party Services and Links

The Site may link to services such as Facebook, Instagram, YouTube, WhatsApp, maps, or other third-party resources. Links are provided for convenience and do not mean that Towwind controls or endorses all third-party content. Third-party terms and privacy notices apply when their services are used.

10 Availability and Changes

We may update, suspend, restrict, or discontinue any part of the Site and may correct errors without notice. We do not guarantee that the Site will always be available, uninterrupted, secure, or free from defects. Maintenance, network conditions, security incidents, and events outside our reasonable control may affect availability.

11 Disclaimer

To the maximum extent permitted by applicable law, the Site and its content are provided on an “as is” and “as available” basis. Towwind disclaims warranties relating to the Site, whether express, implied, or statutory, including implied warranties of accuracy, non-infringement, merchantability, and fitness for a particular purpose. This disclaimer does not alter an express warranty contained in a separately agreed sales document and does not exclude rights or liabilities that cannot lawfully be excluded.

12 Limitation of Liability

To the maximum extent permitted by applicable law, Towwind and its directors, employees, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising from use of or inability to use the Site, including loss of data, profit, revenue, opportunity, or business interruption. Where liability relating to the Site cannot be excluded, Towwind’s aggregate liability will be limited to the greater of the amount paid specifically for use of the Site during the preceding twelve months or USD 100, unless applicable law requires a different result.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, death or personal injury caused by negligence where such liability cannot be excluded, or any other liability that applicable law does not permit the parties to exclude or limit.

13 Responsibility for Breach

To the extent permitted by law, you are responsible for direct loss reasonably incurred by Towwind as a result of your material breach of these Terms, unlawful use of the Site, or infringement of another person’s rights. This section does not require payment for loss caused by Towwind or for amounts that are remote, avoidable through reasonable mitigation, or otherwise unrecoverable under applicable law.

14 Trade Compliance

You must use the Site and any information obtained from it in compliance with export-control, sanctions, customs, and trade laws applicable to you and the relevant transaction. Nothing on the Site is an authorization to export, re-export, transfer, or use a product, software item, or technical information contrary to applicable law.

15 Privacy and Cookies

Our Privacy Policy explains how we process personal information, and our Cookie Policy explains the use of cookies and similar technologies. Those policies form part of the information governing use of the Site but do not create product warranties or sales obligations.

16 Governing Law and Disputes

These Terms and any non-contractual dispute arising from the Site are governed by the laws of the People’s Republic of China, without regard to conflict-of-law principles. Subject to any mandatory law that gives a user the right to bring a claim elsewhere, the courts with jurisdiction at the place where Towwind is domiciled in Shenzhen, China, have exclusive jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not govern these Terms; its application to a product sale, if any, is determined by the applicable sales contract.

17 General Terms

If a provision is found invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign rights under these Terms without our written consent; Towwind may assign them in connection with a reorganization, transfer of the Site, or corporate transaction. These Terms, together with the Privacy Policy and Cookie Policy, constitute the agreement concerning use of the Site and do not replace a separate product or service contract.

The English version controls to the extent permitted by applicable law if a translated version differs. We may update these Terms by publishing a revised version and changing the Last Updated date. Changes apply prospectively from publication unless applicable law requires another form of notice or consent.
